1. Acceptance of Terms
By accessing or using PulseNet services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Services.
These Terms constitute a legally binding agreement between you and PulseNet Labs, Inc. ("PulseNet", "we", "us", or "our"). We reserve the right to modify these Terms at any time. Material changes will be communicated via email or dashboard notification at least 14 days before they take effect.
Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Services and close your account.
2. Services Description
PulseNet provides a decentralized proxy and web data infrastructure platform, including but not limited to:
- Proxy Network: Residential, datacenter, ISP, and mobile proxy access for web data collection.
- Web Unlocker: Automated anti-bot bypass and CAPTCHA solving services.
- SERP API: Structured search engine results data retrieval.
- Browser API: Remote browser sessions with anti-detection capabilities.
- Scrapers: Pre-built data extraction templates for common websites.
- Node Network: A decentralized network of bandwidth-contributing nodes compensated via the PULSE token on Solana.
Services are provided on an "as-is" basis. We do not guarantee uninterrupted availability, specific uptime percentages, or particular performance levels unless specified in a separate Service Level Agreement (SLA).
3. Account Registration
To use the Services, you must create an account. You agree to:
- Provide accurate, current, and complete registration information.
- Maintain the security of your account credentials, including API keys.
- Promptly notify us of any unauthorized use of your account.
- Accept responsibility for all activity that occurs under your account.
You must be at least 18 years old to create an account. Accounts registered by automated methods (bots) are not permitted. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
Each individual or entity may maintain only one account unless explicitly authorized in writing by PulseNet.
4. Acceptable Use Policy
Permitted Uses: You may use the Services for lawful web data collection, market research, price monitoring, ad verification, SEO analysis, academic research, and other legitimate business purposes.
Prohibited Uses: You may not use the Services for:
- Any activity that violates applicable local, state, national, or international laws or regulations.
- Unauthorized access to computer systems, networks, or data (hacking).
- Distribution of malware, viruses, or other harmful software.
- Sending unsolicited bulk messages (spam).
- Harassment, stalking, or threatening individuals.
- Collecting personal data in violation of privacy laws (GDPR, CCPA, etc.).
- Scraping or accessing content in violation of a website's terms of service where doing so is illegal in your jurisdiction.
- Circumventing access controls for the purpose of unauthorized data theft.
- Activities related to illegal gambling, drug trafficking, or human trafficking.
- Generating, distributing, or facilitating child sexual abuse material (CSAM).
- Any activity that disrupts or degrades the performance of the PulseNet network.
We reserve the right to investigate and terminate accounts engaged in prohibited activities without notice or refund. We may also report illegal activities to appropriate law enforcement authorities.
5. Node Operator Terms
If you operate a node on the PulseNet network, the following additional terms apply:
- You must ensure your node complies with all applicable laws in your jurisdiction, including bandwidth sharing and data relay regulations.
- You grant PulseNet the right to route proxy traffic through your node in exchange for PULSE token compensation.
- Compensation rates are determined algorithmically based on uptime, bandwidth contributed, geographic location, and performance scores.
- You may not inspect, log, modify, or intercept the content of traffic routed through your node. All traffic is encrypted end-to-end.
- You must maintain a minimum uptime of 95% per calendar month to remain eligible for full compensation.
- PulseNet reserves the right to remove nodes from the network that fail to meet quality standards or violate these Terms.
- Node operator earnings are settled on the Solana blockchain. Transaction fees are the responsibility of the operator.
- You are solely responsible for the tax implications of any earnings received as a node operator.
6. Payment & Billing
- Services are billed on a usage-based model unless you have selected a subscription plan.
- Pricing is listed on our website and is subject to change with 30 days' notice.
- Payments are processed via Stripe. By providing payment information, you authorize us to charge your payment method for Services rendered.
- All fees are non-refundable unless otherwise stated or required by applicable law.
- Overdue payments may incur a late fee of 1.5% per month.
- Free tier usage is subject to rate limits and bandwidth caps as described in the pricing documentation.
- We reserve the right to suspend Services for accounts with overdue balances exceeding 14 days.
- PULSE token transactions are final and irreversible once confirmed on the Solana blockchain.
7. Intellectual Property
- PulseNet and its licensors retain all intellectual property rights in the Services, including software, APIs, documentation, trademarks, and trade secrets.
- You retain ownership of any data you collect using the Services, subject to the intellectual property rights of the original content owners.
- Our SDKs and client libraries are released under open-source licenses as specified in their respective repositories.
- You may not reverse engineer, decompile, or disassemble any part of the Services except to the extent permitted by applicable law.
- "PulseNet", the PulseNet logo, and "PULSE" are trademarks of PulseNet Labs, Inc. You may not use these marks without prior written permission.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
- WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- IN NO EVENT SHALL PULSENET BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
- OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
- SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY FOR CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
9. Termination
- You may terminate your account at any time through the dashboard settings or by contacting support.
- We may suspend or terminate your account immediately and without notice if you violate these Terms, engage in prohibited activities, or if required by law.
- Upon termination, your right to use the Services ceases immediately. We will delete your account data within 30 days, except where retention is required by law or our Privacy Policy.
- Any outstanding balance owed at the time of termination remains payable.
- Node operators who are terminated will receive earned but unpaid compensation for the period up to termination, provided they were not terminated for cause (fraud, abuse, or Terms violation).
- Sections of these Terms that by their nature should survive termination (including Limitation of Liability, Intellectual Property, and Governing Law) shall survive.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
Any disputes arising from or relating to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in English and held in Wilmington, Delaware.
You agree to waive any right to a jury trial or to participate in a class action lawsuit against PulseNet. Each party shall bear its own costs of arbitration unless the arbitrator determines otherwise.
For users in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.
